We’re getting closer! On May 24, 2017, New York’s Workers’ Compensation Board (WCB) published their 2nd round of draft regulations for Paid Family Leave (PFL) for a new 30-day commenting period expiring June 23, 2017.
Here's a couple of things that caught our attention at first glance:
- The definition of part-time employees has been changed from working less than 5 days a week to less than 20 hours a week.
- Carriers now have until the later of July 1, 2017, or within 60 days of the date the PFL rates are released by the State to declare if they will exit the statutory disability market, and thereby Paid Family Leave. In other words, if the DFS publishes the rates on June 1, 2017 carriers now have an extra 30 days to make that decision and announcement.
