On October 6, 2021, the New York Workers Compensation Board (WCB) updated its regulations to lift the intermittent leave cap, so that New Yorkers working an average 6- or 7-day work week would be able to claim up to 72 or 84 days of intermittent leave benefit respectively. In the past, these NY employees would be capped at a 60-day benefit, i.e., receiving benefits for a 5-day week even if they worked more days per week, on average. This expanded intermittent leave benefit is available to all eligible employees for claims filed after January 1, 2022. It does not apply to claims initiated prior to Jan 1, 2022, which continue to be paid in 2022, so be sure to plan your leave with this guideline in mind.
